1.Midgard Marketplace is an online platform that provides information about goods or services offered by third parties (referred to as "Shops") and is not itself a Seller. The same product may be available from multiple Sellers (Shops), and the price may vary between them. The term "Midgard Marketplace" may also be referred to as "Midgard," "the website," "the platform," "the resource," "the portal," "the marketplace," or "the project."
1.1. Any other websites, mirror sites, projects, channels, or similar entities are unrelated to the Midgard Marketplace and are considered phishing (fraudulent) resources.
2.1. To maintain the website's infrastructure, provide high-quality service, ensure security, enforce platform rules, prevent fraudulent schemes, and exclude low-quality service providers, a fee is charged for opening a Shop and for transaction processing.
2.2. The one-time fee for opening a Shop is $500.
2.3. Commission fees on Shop sales are as follows:
2.4. Withdrawal commission fee: 0% of the withdrawal amount.
3.1. The platform rules include three types of regulations:
3.2. Amendments to these Rules may be made by the Website Administration without prior notice to Users. Changes take effect immediately upon publication on the website.
4.1. To use the services available on the website;
4.2. To sell goods and services in accordance with these Rules;
4.3. To initiate and participate in disputes (conflicts) with Buyers in case of issues related to any order;
4.3.1. If agreement with the Buyer cannot be reached or proposed solutions are unacceptable, the Shop has the guaranteed right to invite a Moderator (a representative of the Platform Administration) into the dispute to independently review the issue, make an objective decision, and close the dispute;
4.4. To use informational materials published on the website, as well as other information provided by the Administration;
4.5. To request assistance via the Support (Contact) form regarding any issue related to the use of the platform;
4.5.1. To request clarification regarding the outcome of a problematic order in accordance with Section 11;
4.5.2. To request account restoration in accordance with Section 11.
4.6. To provide and use franchise services-entering into agreements allowing one Shop (subsequently designated as a "Franchisee") to use the brand and business model of another Shop (subsequently designated as a "Franchisor").
4.6.1. The following types of franchises are available under such agreements:
4.6.1.1.Product-Service Franchising: The Franchisor sells the right to sell products under its brand (name, visual design). The Franchisee must follow an agreed-upon (in accordance with Section 4.7) methodology and sales technology. Each Franchisee operates as a separate Shop with its own income level and efficiency.
4.6.1.2.Production Franchising: The Franchisor sells the Franchisee a ready-made production technology and grants the right to manufacture and sell products under its brand. Under the agreement, the Franchisor provides the Franchisee with access to raw materials, instructions, technologies, work methodologies, and equipment, undertaking the obligation to ensure that products are manufactured in full compliance with established quality standards.
4.6.2. There is no limit on the number of Franchisees or Franchisors.
5.1. By using the website, the User agrees to study and comply with these Rules;
5.1.1. Ignorance of or unintentional violation of the Rules does not exempt the User from responsibility;
5.1.2. Every User should, to the extent possible, oppose any violations of these Rules and report such cases to the Website Administration (via Contact form).
5.2. The User is prohibited from and must agree not to:
5.2.1. Perform any actions that lead to de-anonymization (revealing identity) and/or establishing a direct or indirect connection between any platform participant and a real person, under any pretext or for any reason, in places where such data can be accessed by third parties (orders, chats);
5.2.2. Use hacking, scamming techniques, products, or software that may directly or indirectly harm the marketplace or its Users;
5.2.3. Manipulate these Rules for personal gain or misinterpret their provisions;
5.2.3.1. Threaten or extort another User (Shop employee, Buyer) based on their violation of these Rules;
5.2.4. Participate in any fraudulent activities or actions aimed at gaining unlawful benefits;
5.2.4.1. Use knowingly false information in product listings or Shop descriptions;
5.2.5. Disclose compromising order data or confidential information about another User's account in places accessible to third parties;
5.2.6. Encourage or provoke another User (Shop employee, Buyer) to violate any provision of these Rules;
5.2.7. Use false, distorted, or unverified information about goods, services, reputation, or activities of other Shops on the platform.
5.3. After opening a Shop, one name change is permitted. Any subsequent name change requires a payment of $1,500.
5.4. The Shop is prohibited from selling the following products and services:
5.4.1. Currency exchange services or currency exchange listings;
5.4.2. Software capable of collecting user data;
5.4.3. Weapons, ammunition, explosives, and their components, parts, or materials used in their manufacture;
5.4.4. Poisons and toxins;
5.4.5. Services involving physical violence or force;
5.4.6. Classified state information.
5.5. The Shop is prohibited from:
5.5.1. Selling goods or services outside the website's functionality;
5.5.2. Listing copies of already existing products (duplicate listings);
5.5.3. Selling already sold items (duplicates);
5.5.4. Presenting one product as another (substitution).
5.6. The Shop must:
5.6.1. Be responsible for its partners and employees;
5.6.2. Not employ minors in any capacity or grant them access to its products;
5.6.3. Not list items in incorrect categories;
5.6.3.1. Orders must not contain excessive unrelated text (spam);
5.6.4. Both parties must fulfill all agreed terms and details of the transaction;
5.6.5. Not substitute goods outside the website's functionality without Moderator approval;
5.6.6. Unconditionally comply with instructions and decisions of the Platform Administration and respond appropriately to warnings and notices;
5.6.7. Ensure delivery of the paid-for product to the Buyer;
5.6.7.1. In the event of force majeure, the Shop remains obligated to fulfill these responsibilities.
5.7.Penalties and Sanctions for Violations
5.7.1. In cases of a critically high dispute rate or recurring quality issues: Shop suspension or blocking;
5.7.2. The statute of limitations for violations is 1 year.
6.1. To use the services available on the website;
6.2. To receive the purchased order (product or service) as described and matching the provided specifications;
6.3. To contact the Shop Administration in case of issues with an order;
6.3.1. If agreement with the Shop cannot be reached or proposed solutions are unacceptable, the Buyer has the guaranteed right to invite a Moderator (a representative of the Platform Administration) into the dispute to independently review the issue, make an objective decision, and close the dispute;
6.4. To independently close a dispute upon reaching an agreement with the Seller;
6.5. To use informational materials published on the website and any other information provided by the Administration;
6.6. To request assistance via the Support (Contact) form regarding any issue related to the use of the platform;
6.6.1. To request clarification regarding the outcome of a problematic order.
7.1. By making purchases on the website, the User agrees to study and comply with these Rules;
7.1.1. Ignorance of or unintentional violation of the Rules does not exempt the User from responsibility;
7.1.2. Every User should, to the extent possible, oppose any violations of these Rules and report such cases to the Website Administration (via Contact form or to the Moderator during a dispute).
7.2. The User is prohibited from and must agree not to:
7.2.1. Perform any actions that lead to de-anonymization (identity disclosure) and/or establishing a direct or indirect connection between any User on the platform and a real person, under any pretext or for any reason, in places where such data can be accessed by third parties (orders, chats, reviews);
7.2.2. Use hacking, scamming techniques, products, or software that may directly or indirectly harm the marketplace or its Users;
7.2.3. Use a display name or Shop name visually similar to that of a Platform Administration representative;
7.2.4. Manipulate these Rules for personal gain or misinterpret their provisions;
7.2.4.1. Threaten or extort another User (Shop employee, Buyer) based on their violation of these Rules;
7.2.5. Participate in any fraudulent activities or actions aimed at gaining unlawful benefits;
7.2.6. Initiate or conduct purchases through private messages or outside the website's functionality;
7.2.7. Initiate money transfers to external wallets outside the website's functionality;
7.2.8. Encourage or provoke another User (Shop employee, Buyer) to violate any provision of these Rules;
7.2.9. Use false, distorted, or unverified information about goods, services, reputation, or activities of other Shops on the platform.
7.3. The Buyer must:
7.3.1. Unconditionally comply with instructions and decisions of the Platform Administration and respond appropriately to warnings and notices;
7.3.2. When placing a pre-order or arranging postal shipment, agree with the Shop via chat on all terms and details of the transaction before payment and shipment;
7.3.2.1. After payment, the Shop must ship the goods within the agreed timeframe;
7.3.2.2. Both parties must fulfill all agreed terms and details of the transaction.
8.1. Determine whether a User's action violates these Rules and apply appropriate decisions and sanctions on a case-by-case basis. The application of these Rules remains at the discretion of the Administration;
8.2. Send informational messages to Users by any method it deems appropriate;
8.3. At any time, modify the website's design, content, service offerings, software, server applications, and other objects used or stored on the site, with or without prior notice;
8.4. Provide comments or explanations regarding any decision - or choose not to provide them at all;
8.5. Conduct necessary preventive or other works at its sole discretion, with or without prior notice to Users. The website and services may be temporarily unavailable due to scheduled maintenance, technical issues, or other technical reasons;
8.6. Delete Shops that have not conducted commercial activity for more than 180 days.
9.1. Losses arising from a User's (Shop, employee, or Buyer) failure to fulfill their obligations, as the Administration is a neutral and disinterested party;
9.2. The one-time fee for opening a Shop and transaction commissions;
9.3. Losses resulting from a recipient rejecting a transaction after funds have been withdrawn;
9.3.1. If a recipient rejects a transaction, the funds will be permanently lost. Transactions cannot be canceled or reversed after completion. It is recommended to use long-term receiving addresses (not temporary ones) and transfer funds to a cryptocurrency wallet for storage before performing further operations.
10.1.Moderator - a representative of the Platform Administration authorized to review and resolve disputes between Shops and Buyers. The Moderator acts as a neutral and independent third party and is invited into a dispute when the parties fail to reach an agreement.
10.1.1. The Moderator makes decisions based on the specific circumstances of each case, relying on available evidence, objective factors, and other data (including information not accessible to Users), in accordance with current platform rules. The Moderator evaluates the evidence provided by both parties in relation to the stated claim.
10.2.Support Department Staff (referred to as "OS" or "Support") - a representative of the Platform Administration authorized to provide consultative and informational assistance to Users regarding any questions or issues, process user requests, and coordinate specialized inquiries by topic.
10.2.1. Informational support is based on materials published on the website and other data (including non-public data), in accordance with current platform rules.
10.3. In its operations, the Website Administration follows these Rules, internal regulations, and relevant work methodologies, which are continuously updated based on current platform activities and darknet market trends - to ensure high-quality service, fair transaction moderation, enforcement of these Rules, security, and prevention of fraudulent schemes.
10.4. Disagreement, attempts to change, or influence any decision made by the Administration (regardless of how significant it may seem to the User) do not constitute grounds for modification. All decisions made by the Administration are final.
11. When submitting a request via the Support form, the User must clearly describe the specific issue and provide relevant justifications and evidence;
11.1. If the nature of the problem cannot be determined or if evidence is missing, the request will not be considered;
11.1.1. If the User fails to follow the required format for submitting a request (after being informed of the format), the request will not be considered;
11.1.2. Each request regarding a specific order or dispute must not reference unrelated transactions. Each such request will be reviewed solely based on the specific order and direct reference to it.
11.2. Requests made with the intent to prioritize one's case contradict the principles of equality and fairness. The Website Administration does not categorize disputes or requests as "priority" or "less important." All cases are reviewed promptly and in the order they are received.
